Misleading?

Hi,

I ordered an item which was described as M&S, when I received it, it was primark, in my eyes this is misleading but the seller says no, any advise on this please?

Open a not as described case to get a full refund. Do not take any notice of seller,  if thinks wrong name is not misleading, not a very good seller.

Seller has to provide a return label and on return refund in full.
