I bought an iphone online on 8th Nov.
The listing pictures are not of a genuine iPhone so I contacted seller and also ebay - ebay took no action and asked me to request refund from seller who later declined (surprise).
The seller doesn't respond to messages for a long time.
Dispite using 'simple delivery' item not posted and seller not providing tracker details so opened up an 'item not sent'
Seller could now send fake tracking details or send me fake phone or something else (and then dispute what I return was what he sent) - seems like the seller is running the clock down to get paid before closing account. Whilst I may get a refund via guarantee, ebay may end up paying seller.
I've been in contact with ebay multiple times seems they are fine not to take action despite it being obvious this is seller fraud - what more can I do?

The seller only has a short period od time to respond to your case.
After 3 days, unless the item arrives or you get a refund, ask Ebay to step in.
I am a bit confused by the opening line of your post where you say 'the listing pictures are not of a genuine iphone'. Why ever did you make the purchase then?
As long as you have opened an 'item not received' case, unless the seller provides tracking proving delivery to your address, you will get a refund. You don't need to contact Ebay multiple times, just keep an eye on your opened case and ask Ebay to step in as soon as possible.

Why did you go ahead and buy it?
Fortunately, it's a buyers playing field and you're covered by eBay against your item not arriving, or not being as described if it does.
