Do you mean you opened a not received case, as that is how you deal with not received items. If so your case would close if tracking now shows as delivered.
Getting ebay to look into this will be difficult, so I suggest contacting your payment provider and explain item not received and tracking provided is false. They are much more likely to investigate properly.
If case is still open, as the tracking would need to satisfy ebay, and you really do not give enough information, then escalate the not received case for ebay to sort out.
