Item not as described

I  bought and paid for a cutlery set advertised as 44 pieces, when it arrived it only contained 37 pieces all the teaspoons were missing and one fork, so I contacted the seller and we agreed to a partial refund, the seller contacted me saying she had found two of the teaspoons so we agreed to adjusting the refund and she would post the teaspoons that she had found, she then contacted me saying that eBay wouldn’t let her do a partial refund and suggested putting the refund money in with the teaspoons and I said okay, as it was just easier or so I thought, but nothing has arrived, I don’t want to send the set of 37 back as I’ve been caught out by eBay return policy before and I’ve ended up out of pocket for the return postage, eBay need to wake up to that

Hi, thanks for the reply, the 30 days hasn’t expired yet, but I am beginning to wonder if the seller is trying to fob me off until it does and get away with everything, I might be trying to work things through with my seller and they are using that

You haven't ended up paying that return postage,  as you received an item not as described, if you follow eBay's 30 day MBG Money Back Guarantee policy, the seller  if they want their item back, has to pay for that fully tracked return postage.

 

eBay can only  enforce a full refund  for the above reasons if the return case is opened within 30 days of the item's last estimated date for delivery.  Partial refunds are not part of the MBG,  cannot be enforced.  A lot of trust has to be accepted here as this is entirely between you and the seller.

 

Seems the seller fobbed you off with promises and has not kept them.  Has the 30 day limit passed?  If not return the incomplete set for a full refund,  seller pays for the return , and buy the set again from a more reliable seller.

Just a point that you could help me with, the reason I said I would be out of pocket for return postage is because in the past an item arrived broken and before eBay would refund me the £200 I paid for the item I had to return the broken item and I had to pay for the return postage and this was not refunded to me at the end, so are you saying that eBay have updated their policy and now I’m not responsible for the return of the item?

Nope the policy hasn't been update.  

 

Not sure about that last case you opened but if you open the wrong case in error say item does not fit reason for example,  there you have to pay for that return postage.

 

It's always been the case if you receive an item not as described, e.g. broken, parts missing etc. that is, item not as described, and  a case for this is opened citing... Item Does Not Match Description or Photos, then everything you as a buyer paid initially including postage is refunded. 

 

If the seller wishes the item to be returned first they have to pay for that tracked return postage.  Again this is not a new policy.
