Item never received, but eBay refused to refund £70

I'm eBay use over 18 years, but recently feel like eBay hates me for some reason:( 

In November 2024 purchased item (used aquarium filter), which never arrived. 

Royal mail has delivered parcel to communal bins next to our block (absolutely unsafe place accessible to public of main road)! 

However eBay declined refund/ closed case based on R.M. tracking "Delivered" . 

When I've appealed, eBay told/and wrote me to request "Proof of non delivery" document from Royal Mail. 

It was during Christmas holiday time, so it took while and sevar emails untill R.M acknowledged misdelivery to unsaved place, with comment that "Proof of non delivery" document does not exist and that I was given misleading ifo from eBay!

I have then sent copy of R.M emails to eBay as proof of item not received. However eBay still refused to refund, claiming that 30 days of customer protection guarantee have passed 😞 

Also PayPal refused my claim, based on that eBay provided tracking info "Delivered" . 

And Royal Mail is refusing my claim, because I'm recipient, not sender. 

Also R.M. has told me, that sender has indeed made claim for this lost parcel. 

So it is likely, that seller got £70 from my purchase and also £70 compensation from Royal Mail.  Seller was initially very unhelpful and now won't reply any more at all.

Yet I've lost my money, no item and lost hours of my time to pursue this 😞 

And to add to my insult, eBay removed my negative feedback to the seller! 

... I wonder if that is what I get for 18+ years of custom ?

... Or is it now new eBay's policy to side always with sellers ?

If you funded the payment with a debit or credit card, you could try a not received chargeback.

 

If you have proof (photo) that the item was delivered to some bins in a communal block you should get a refund that route.

 

Also R.M. has told me, that sender has indeed made claim for this lost parcel. 

 

Do you have that in writing too?

If you look at the RM claim form it is made for completion y sender or recipient. The fault was with the delivery, so you should be able to claim on RM, except of course you would now be out of time.

Thanks for comment. I've exchanged several emails with Royal mail , as well as phone calls with R.M. customer service. All have told me that I cannot make any claim as recipient. I've never seen such online claim forms. 

I guess complaint about Royal Mail is in order, but to higher instances! 

Samo for eBay though, as both have repeatedly provided misleading informations!!! 

... A War, which I'll never win, just waste more time 😞
