Item is damaged but seller sending a replacement

Hello I have purchased a guitar which came from China. This took more the 1 month to arrive. On its arrival the guitar was badly broken due to transit. The seller has said that they would send a replacement, which I am fine with as long as they are true to there word. so really my question is do I contact ebay to make them aware of this and how long can I give them before I request a refund if the item does not arrive. Is there a direct number to contact ebay? rather than email or bots. PS The purchase was made using paypal . I am however hoping that The seller will send a replacement. I just want to make sure that I am covered . Thank you.

For any buyer protection you need to open a case of not as described/damaged and ask for a refund rather than a replacement that may never appear,as some chinese seller like to drag you out of time to make an y claims against them,so they retain your money,
