I purchased an item and it has been lost by Evri. The tracking went dead and then said it was arriving a week ago and then just went dead. It's a one off item so cannot be replaced. I have opened a case requesting a refund but Ebay have put the case on hold until today. The seller is saying it's not his fault and won't refund me, but I did pay buyers protection. So what do I do now?

You wait until the time to escalate appears.
Opening a case gives the seller 3 days to accept and either refund you or enter a tracking number to show delivery for the item, which would close the case in their favour.
Those 3 days are timed to the second, the option to escalate will not appear before that timeline lapses.
Once it does escalate, with no tracking you will be refunded.
Do not close the case early for any excuse or promise the seller may make, and do not forget to escalate!
