Sometimes sellers do not send a return label as the cost is more than the value of the item, if this is the case they need to refund you within 3 days, or you need then, to escalate the case and eBay step in and force the refund.
Has 3 days lapsed? If so, and the option to escalate is not there, still asking for the item to be sent back, contact eBay Customer Services, explain there's an issue with the label, they will send another, and charge it to the seller's account.
Or, they may just make a discretionary refund for you now, and close the case, in which case you keep the item.
