I sold a item buyer wanted return , eBay as payed him for item in his favour he as not returned it

I sold my ebike buyer was happy he wanted a return. , I said I wasn't happy he won case ,  I spoke to him on phone he said he is not returning item he won the case.  , I've got evidence in text him saying.  He is not returning item he collected , he got full refund  his still got  the item refuses to return it  ,that's wrong I lose my item I sold that's a breach of policy. eBay payed a return he refuses to return it  is that not theft  can you help me resolve this  or some advice please thanku

If a seller just refuses a not as described case and the buyer escalates it, eBay finds for the buyer, forces the refund and leaves it up to the seller to try to get the item back.

 

In any event, as a  private seller are not allowed to sell e-bikes.

When a buyer asks for a return through Ebay, your choices are limited.

You can accept the return and arrange to get the item back, refund without return, or message the buyer.

If you don't accept the return and arrange to get the item back, the buyer can ask Ebay to step in.  Then Ebay refund them from your funds without needing the buyer to return the item.

These are terms which you agree to when you sell on Ebay.

This is now between you and the buyer.

Although Ebay 'rules' say the buyer can keep the item, you can contact them and ask for your bike back.

You would be expected to arrange and pay for it to be returned.

If the buyer refuses, it might be worth taking legal advice to see what 'next steps' you could take.

No, I'm afraid it isn't.

 

In the user agreement, you agreed that eBay would decide whether a buyer has to be refunded, and whether the item has to be returned. You also agreed to accept their decision.

 

If you had accepted the return and sent the buyer a prepaid label, eBay would have required the buyer to return it with proof of delivery before they were refunded. If you didn't, eBay will have enforced the refund without requiring the item to be returned.
