Hi all,
Unfortunately, I have an item that hasn’t arrived.
Have waited for the required before I can request refund. Within the time of waiting for the deadline I was in touch with the courier whom have agreed they have lost my parcel. EBay replied to me with my refund request stating “the seller states the parcel is still on its way to me” and I have to wait another 10 days before they can “look into” my refund request. I have email proof, addressed from the courier which states loss of item. Why does eBay not allow me to show proof? Is this not borderline bullying? Allowing only the seller to have a say? Especially when I have proof??? Help because I am not waiting another 10 days just because seller doesn’t know how to use a decent courier.

This is how to proceed to claim a refund if your item does not arrive in a reasonable time, be aware those estimated dates are just estimates, not a confirmed date sometimes a tad optimistic, so worth waiting a few more days.
If a reasonable time passes with no item, you cannot open a case until one day After that last estimated date for delivery, then proceed this way:
Go right of the item purchased, and from More Actions select.... I Have Not Received My Item.
If you are not fully refunded within 3 days, you must escalate the case on day 4 or within 30 days from opening the case, and eBay will step in and force the refund.
Do not close the case early for any excuse or promise the seller may give, and do not forget to escalate.

By "refund request" I take it that you have opened a case under eBay's money back guarantee, and escalated it after three days for eBay to step in?
If so, you will probably just have to wait the extra 10 days eBay has apparently allowed the seller to prove delivery. You could contact customer support about your email from the courier admitting it was lost. Cases are not dealt with by eBay customer support, but they may be able to advise you how to send this information to the appropriate part of eBay.
However, eBay is robotic in following their procedures and having given the seller an extra 10 days my guess is that they will not re-examine the case until then. It will then be decided according to the tracking record. If it's confirmed as undelivered, you will get your refund. If the cases is decided against you, you will have the opportunity to appeal by providing new evidence, when you can introduce the email from the courier.
