Personally I would not buy anything of this nature from a seller on ebay. You dont know the  authenticity of the eye patches, and as you have found, they are dodgy, from a dodgy seller.

My advice is to use a  reputable retailer.  You say you've opened a case so make sure to escalate it for your refund.

Yes it should, but eBay isn't an enforcing authority. They take no responsibility for items sold here, beyond their own 30 day money back guarantee. You accepted this in the user agreement. The seller is entirely responsible for the listing.

If the seller is a UK business seller I suggest that you start by consulting Trading Standards. I don't know whether eye patches are covered by any specific safety or quality standards. If they're a private seller, I doubt whether there's realistically anything you can do.

You also have to take some responsibility for your own decision to buy these eye patches from an unknown eBay seller, not from a shop. eBay even warns buyers that "they do not guarantee the existence, quality, safety or legality of items advertised, or the truth or accuracy of descriptions".

Would you have bought eye patches from a shop that stated this? It was your choice, your risk. eBay is a jungle.

Let's hope that your awfu experience serves as a warning to others.

I wouldn't buy any product from an online stranger that you use on eyes or skin unless it's the own brands online store or a reputable UK registered business seller who is licensed to sell that brand. I recall a time years ago when the popular make up brands were being faked and sold and, when tested, they contained all manner of nasties.

You may be able to report your seller to Trading Standards if a) they are a UK registered seller and b) you still have some of the product left.
