Fraud on ebay

I bought and paid for an iPhone 16 Promax 256gb. Seller g7fs4-26. They sent a black ballpoint pen to an address that wasn't mine. Luckily, I went to my local sorting centre with all the proof, and a great fellow told me the name and address they sent it to. they had sent a black ballpoint pen to fool the eBay system, and yes, it worked.  eBay, I complained, but there was nowhere to upload photographs, eBay are complicit as far as I'm concerned. this guy used their simple postage, but the thing weighed nothing. I am so sick of eBay. I have buyer protection. Can you contact a human to get my money back no?  do the robots understand eBay buyer protection again no.

no, because they sent it to a local indian restaurant, and the post office is investigating it. he would not let me have it. But I got the photos. why, what are you thinking?

Let's hope you do. As you have discovered, eBay's initial response is that if it's tracked as delivered, it's been delivered. We often hear that eBay has placed the onus on the buyer to prove incorrect delivery. Unfortunately, they don't take the buyer's unsupported word for anything - not even that the photo to prove delivery isn't even their address!

 

It's hard to help with so little information. Does the tracking record confirm the address or even postcode to which it was delivered? Even if not, your friend at the sorting office may be able to give independent confirmation that it was not delivered to your address.

 

We don't know wherther this was a business seller or a private seller, who would probably have used eBay's simple delivery system. If so, it gets very complicated as eBay would be responsible for refunding for loss in th eost, but the seller would be responsible if it was proved that the item enclosed was not as described.

 

You will need to start by opening a case under eBay's money back guarantee. If the item was lost, or never reached you, you would open an item not as received case. But if the packaging (with or without the ball pen) reaches you you would open an item not as described case.

 

Good luck, and be sure to keep copies of all docuents and web pages. If eBay won't give a refund you may have to try your payment provider, e.g. credit or debit card issuer.

 

Buying from strangers on eBay is not without risk, especially phones. For example, did you realise that eBay's money guarantee can expire before a phone is reported as stolen, and is locked or blocked. But after 30 days, no buyer protection from eBay. If you wish to buy a phone here it's safer to stick to well established phone sellers with plenty of good feedback.

i have buyer protection but have spent the whole day going from soting office to business i now have all the evidence but as i raised the claim last night you can not even add the evidence the system is useless i cant raise another complaint so the algorithm's decide on half the evidence no wonder people do this ebay is complicit by having such bad fraud protection.  lets face it, collectively we are all paying a premium for this buyer protection because their systems are so bad. I spoke to a robot, and she didn't even know the word fraud, which should raise the status, but no.  My problem is how long until the buyer protection pays out? I can't afford another £700 to buy another phone for my daughter, and hey, where do I buy it? obviously, eBay isn't safe.

You are confusing the buyer protection fee with the money back guarantee. 

 

The buyer protection fee is not for issues with delivery.

 

Your best option is to get hold of the package and make a claim for item not as described.   

 

A claim for item not received involves evidencing that the address on the tracking is not the address you used at checkout.
