Remember that eBay did warn you in the user agreement that "they do not guarantee the existence, quality, safety or legality of items advertised, or the truth or accuracy of descriptions".
Would you have bought this from a shop that stated this? You knew or should have known the risk of buying from strangers here. eBay isn't like the shops. eBay is a jungle.
