I purchased a gift for my son for Christmas and they have broken but under the manufacturers warranty. Went to Apple and was told they are fake. Can I get my money back from eBay or the seller as they stated they were genuine Apple AirPods?

You can certainly ask the seller but it's too late to do anything about it via ebay. They only allow 30 days and don't get involved with warranties. If the seller won't help contact your payment provider and see what they can do.

Buying from unknown sellers on eBay isn't like buying from the shops. The user agreement even warns buyers that "eBay does do not guarantee the existence, quality, safety or legality of items advertised, or the truth or accuracy of descriptions". So you knew the risk you were taking - would you have bought them from a shop that said this? eBay is a jungle.
If you paid by or funded your payment from a credit or debit card your card issuer may be able to help. Either may be able to issue a chargeback if you have evidence that it was counterfeit. If you paid by credit card you may have additional protections.

You're out of time to do anything via your debit or credit card provider (120 days from payment date), but if your seller is a UK registered business seller you may want to get in touch with Citizens Advice and see if there's a way of pursuing this via a legal claim.
I'd also report them to Trading Standards (again, if a UK registered business).
