Ebay failed to help

I recently bought a wii controller. It was delivered but didnt work so I informed the seller straight away. The seller promised to send another one by the next working day but it never arrived. In the meantime, I also ordered another wii controller just in case the other one didn't come. The second controller worked so I provided positive feedback. The seller names were different so I didn't realise that it was the same seller using two different names! When I asked for a refund for the first wii he said that I had provided positive feedback. When I pointed out that it was a different order and seller name, he stopped responding. I contacted ebay support to get a refund. Today ebay told me that the seller showed that the order was delivered to my address so case was closed and I will not get a refund. No reference to the fact that I effectively bought two controllers. Has any one had Ebay successfully refund their money from dodgy traders? I don't trust ebay anymore. They just don't seem interested. As for this rogue trader, ebay let him carry on but others will find him out too.

You have gone about this in the wrong way. 

The first controller you received was faulty so you needed to open a "Not as described" case. Your seller would have been forced by ebay to send you a tracked return label so you could return for a full refund. If he failed to send you a label you would have escalated the case and ebay would refund you.

It sounds like you may have opened a "Not received" case which you would lose because you did receive it.

 

If the second controller is also faulty you should open a second "Not as described" case.

Don't talk to the seller, just stick with the cases.
