I'm confused as to how Ebay can send me a "new return request message" telling me I need refund the buyer for a used item that seemingly has gone faulty after 35 days without any option to decline the refund/return, the buyer gave PFB weeks ago so it was working as expected, I'm a private seller with returns not accepted.

If more than 30 days have passed the item's last estimated date for delivery a buyer may be able to open a case but will not be able to escalate it.
Just make sure that it is 35 days plus, even on day 29, it would count as a valid case, and they can escalate for a refund.

Where are you counting the 35 days from? The money back guarantee for item not as described claims runs for 30 days from actual delivery, or estimated delivery, whichever is later.
