I purchased a (supposedly) Tiffany necklace for my granddaughter for Christmas, it arrived with all packaging of Tiffany. The necklace was in a heat sealed bag as it was for a present I did not open it. I ordered another one from a different seller on examination I realised it was counterfeit. I was within the 39 days and therefore received my money back but unfortunately the first one was over the 30 day period. I contacted eBay stated that it was counterfeit they said contact the seller. I did she offered me £10 which I refused she also quoted the 30 days time limit on eBay. Surely if it isn’t noticed that it is counterfeit eBay should automatically step in and get the money back! I have reported her to eBay but she is still selling counterfeit goods.

You are clearly aware of the 30 day limit for returning an item on Ebay so need to closely examine any item you buy inside that time frame.
Try your payment provider for a refund.
I would advise that if you want Tiffany, you buy it from a Tiffany dealership - taking your granddaughter to a Tiffany branch in London would be a fabulous experience for both of you.

If you just want your money back, your payment provider is a better bet.
It will be a quicker process than the small claims court and you won't have a fee to pay,

Unfortunately the days of travelling to London or anywhere else is out of the question, I’m old and have a lot of health problems, that is why I shop online!
I did report it to eBay but they still allowed the person to sell counterfeit goods including Tissot watches priced at £198 starting price now. EBay don’t care as long as they are receiving money.

So using Klarna gives you no protection if you can't use the ebay money back guarantee?
Perhaps that's a good reason not to use them. I always use PayPal for that extra security.

It is up to buyers, if they open claims of not as described, ebay picks up when too many claims are made.
If only buyers were aware that so many items on ebay are fake and as soon as identified as fakes, opened proper cases within 30 days, as it would prove Very expensive for seller.
Reporting items as fake is only any good if you are in a transaction with seller, but using your payment provider to get a refund is usually effective.
I am not sure how Klarna works, but usually when buying using credit, the money comes to you and you then pay seller. If that is how it worked and you paid from bank account, speak to bank.

A sorry tale - I only hope that other buyers will learn from your experience.
Buying from unknown sellers on eBay is not like buying from the shops. Many don't know or care about any statutory consumer protection you would expect from a reputable retailer - and there is no statutory consumer protection anyway when buying from private sellers or sellers in other countries. Even manufacturers' warranties are liable to be invalid for items bought on eBay.
eBay warns buyers in the user agreement that they do not guarantee the quality of items sold here, that descriptions will be truthful or accurate or that items for sale will be safe, legal - or even exist. Would you have bought from a shop that stated this??
When buying on eBay you MUST open and check items immediately. eBay's own money back guarantee gives strong protection for 30 days - but from day 31 they will have no interest. Many buyers have discovered too late that their items are counterfeit, or their mobile phones stolen and blocked. (Or even that the cars they have bought don't exist - although motor vehicles would not have been covered be eBay's buyer protection anyway.) eBay is a jungle.
As you say, paying by credit card (preferably) or debit card at checkout can in many cases add a further layer of protection.

Just for future reference and for anyone else reading this, top designer brand jewellery never comes in a plastic bag, this is a red flag.
I'd persevere with Klarna over this if you can - as you say you can't claim via eBay because it's over 30 days, that shouldn't prevent you from following this up with Klarna under their 120 day buyer protection policy. You may need some kind of written proof that the piece is counterfeit though.

Paypal, like Ebay, only give a buyer 30 days to make a claim for an item which is not as described.
They used to allow 180 days but changed to 30 some time ago.
