Been selling high performance motorbike shock when buyer received he said in his opinion items was previously used and he wants a refund. Refund been paid from my account but buyer never send my items back. When I was spoke with eBay over the phone that person been rude and on the end I been told eBay fisicly can't tell buyer to send my items back when I was asking in your opinion buyer can keep refund and items he said yes and starts lough. Two days ago I was opening a case to the court but I need defendent email address to process that. Any suggestions? Item value £574.9
Also I have two another two auctions when I'm looking another £400 there is no eBay protection

When buyer opened case, you should have sent returns label and only refunded when received back.
As you refunded 1st, ebay assume you don't want item back and close case.
This is now between you and buyer.

If you did thinks properly then you would not have unnecessary problems.
Buyer should have opened a NOT AS DESCRIBED CASE, you provide a return label and when received back you refund.
Sounds as though no case was opened you refunded without paying for buyer to return.
Only way you may get it back is to send buyer a paid label.
Ebay protection always requires buyers and sellers to use correct procedure.

When buyer opens ebay case, they put a hold on disputed funds.
They don't refund buyer immediately.
