If through Ebay they are well out of time, as case has to be opened within 30 days of expected Arrival. Case should just close automatically.
They are still in time to open a Paypal Case which allows 180 days, although this is mainly intended for delivery from overseas, not buyers who just don't take any action within a reasonable time.
