seller refuses refund

Help! I have had to open a case as the item I bought never arrived.The seller believes that a photo of the postal receipt (sent economy) should warrant enough info as to avoid paying or part paying for my loss.We have ping ponged responces however I now want ebay to step in and resolve.I can't understand the responce page as there is no info/highlighted box to show how I ask them to do so....it just keeps repeating 'continue' and sends me straigt back to the  page to re contact her? Guess it is just that I am missing something somewhere.Please help.

You have to wait 8 days from opening the case before ebay will step in,   escalate the case on the 8th day to be refunded, ignore the seller they obviously have idea what there doing!!..........
