I have opened a case with ebay , regarding an item i bought that has coe damaged.

 

The seller will not accept a return, but ebay status says to let them know when i have sent the item back.

I spoke with the seller and they have yet again told me that they are not accepting it.

 

where do i go from here?

I assume you have opened the correct case in the resolution centre -  "does not match sellers description".

When your case has been open for 8 full days ( so day 9) you will see the option to ask ebay to step in.  when you do, they will send a pre paid returns label at the sellers expense.  Add the tracking number into your case details.  When tracking shows the item has been delivered to the seller, your refund should follow.
