opened a case due to a old 360 arriving not as described.

sell sent me the following;

please note i have spoken with ebay and it could take up to 30 days to resolve. i am also contacting my solicitor as the pictures clealy show the front flap missing and also i have pictures of the condition of the xbox before sale and the console serial number has been recorded for security purposes and as such the faceplate was not loose when sending. also to note my paypal has a hold of funds on it which will stop me from buying and selling as this is the case i am considering legal action for loss of earnings against all party,s involved

really? are they just being silly? it's only £38.

Yes absolutely [24/5 is not "30 days"!]  - when they fail to send you the return label by then escalate the case.   EBay will  then give this silly seller a defect too [and well-deserved]
