opened a case due to a old 360 arriving not as described.
sell sent me the following;
please note i have spoken with ebay and it could take up to 30 days to resolve. i am also contacting my solicitor as the pictures clealy show the front flap missing and also i have pictures of the condition of the xbox before sale and the console serial number has been recorded for security purposes and as such the faceplate was not loose when sending. also to note my paypal has a hold of funds on it which will stop me from buying and selling as this is the case i am considering legal action for loss of earnings against all party,s involved
really? are they just being silly? it's only £38.
In effect "yes". I assume that the other party is the seller. If YOU opened a case for "not as described" it most certainly will not take 30 days. Indeed if you leave it that long it will time-out! EBay have no facilities to "inspect" goods and "always find for the buyer".
Whether or not they have "spoken to eBay" all you do is escalate the case to eBay after 8 full days. If the seller responds they may well then issue you with the return label to return [tracked] and input the tracking number to the case for a refund. If they don't reply to eBay then you may even legally get to keep the item
Cease any back and forth with the seller and leave it to eBay.
Would anyone really contact a solicitor for £38. A pig has just flown by ...
