A seller sold me a counterfeit watch which was described as being genuine - they even used photos of a genuine item.
I have asked the seller to allow me to return it and they want me to keep it. I asked eBay to intervene and they closed my case saying it is not covered by their money back guarantee. The item received was not the same as their listing.
I am now out of pocket with a fake watch.

Opening a case for item not as described, the seller cannot refuse this, they have to accept it, and if they wassnt their item sending back first they pay for a fully tracked return postage.
if you are notnrefunded in 3 days, you escalate that case to eBay, and they step in and force the refund.
If you opened a straight return here, not one for item not as described, the seller can refuse it.
If you did not escalate in time, the case closes from inactivity, eBay thinking because you did not escalate, then the matter has been resolved between you and the seller.
