eBay have over 1.3 billion listings on at any one time so impossible to check each and every one. Some members reporting items as fake and they can be disgruntled buyers or competitors so every instance has to be investigated and an item / seller cannot you must appreicate be removed by one report.
The only way to get a seller booted off for continually selling fakes, is if the buyers do a proper job, that is, to open those item not as described cases if not resolved they result in strikes on that sellers account, doesn't take too many strikes to boot that seller off the site for life, no comeback for them on eBay.
