just bought on eBay and I saw suddenly a “UK VAT added to price” for the first time is this correct

Hi,

I just bought an item on eBay and I saw added to the final price before payment a "UK VAT added to price" to a value of 20%. I have never seen that before in more than 18 years on eBay. The seller is in UK and I am also in UK. Is this correct and have I really to pay it?

thanks.

Lau

Is it not us buyers that are being
abused by ebay then because someone here has said even though the items are
listed as in uk warehouses if the sellers have a business registered in
another country? Then ebay themselves are classed as the seller so if
this is the case ebay know before hand so why not add the vat *bleep* onto
the listing instead of letting us buy an item at £400 letting us pay
then after processing it add another £80 on it .

That doesn't make any sense.  It is impossible for eBay to charge VAT after you have paid.

The only time that VAT is charged subsequently is when the item is located outside the UK at the point of sale and is over £135.  That is because items over £135 are subject to Import Duty as well as VAT, so Import VAT and Duty are collected by the carrier at the point of importation.

For all other items sold by an overseas seller eBay is responsible for collecting and remitting Supply VAT.  For 'Buy it now' items the VAT is now included in the listing price (used to be added at checkout) based on the buyer's default delivery address.  For 'Auction' style listings and items sold with 'Best Offer' the VAT has to be calculated at checkout.

purchase ??? I bet not unless you hounded them for one .

Where eBay is responsible for collecting and remitting VAT a VAT invoice is available to download.

Ebay absolutely definitely does not collect VAT from us.

Ebay only collects VAT from their customers.
Ebay's customers are the businesses that sell on Ebay.

Ebay does not charge VAT on goods you or I buy through Ebay.

Ebay only charges us VAT when we buy services from them.

I see the idea that Ebay charges someone else's customers VAT is part of
the scam.

That is completely incorrect, eBay is legally required to collect VAT on items sold by an overseas seller:

https://www.ebay.co.uk/help/policies/selling-policies/tax-policy?id=4348&st=3&pos=4&query=Tax%20poli...

As a buyer:

  • eBay is required to collect VAT on certain orders delivered to UK addresses:
    • Orders up to £135 sent from outside the UK
    • Orders where the item is located in the UK, but the seller is not a UK business
  • There is no longer a VAT exemption for importing small consignments up to £15 into the UK
  • You'll see the VAT included in the order total at checkout, and can view and download a tax invoice from the Order details page in your Purchase history
  • On orders over £135 imported to the UK, the recipient may need to pay VAT as part of clearing the parcel through customs
  • Where eBay is required to collect UK VAT, eBay will collect VAT on all transactions unless the buyer has provided a valid UK VAT ID

This is in accordance with the changes to VAT treatment that were introduced in January 2021:

Negative.

Every seller on Ebay must include VAT in the asking price.

If the seller describes the item without VAT,
and then charges slips VAT at the last minute,
the item is not as described.
If the item is not as described it can be returned FOC
with a full refund.

I recently bought something from abroad.
The ad showed; -

*Roof rack for Subaru Outback Estate 2003-2007 with integrated flush

positiveSeller's other itemsSeller's other itemsContact seller£109.00*

My receipt showed: -

*Subtotal £90.83Postage FreeVAT £18.17*

That is the non-scam way for foreign sellers to do it.

Only if they are VAT registered and responsible for collecting and remitting VAT on the purchase.

Overseas sellers with stock held in the UK are only responsible for collecting and remitting VAT when selling direct to consumers.  For items sold via a marketplace it is the responsibility of the marketplace to collect and remit VAT and, therefore, the responsibility of the marketplace to ensure that the advertised price is shown correctly.  Overseas sellers are not responsible as they are deemed to have made a zero rated supply to the marketplace for such sales.

You are correct, though, that the advertised price should be inclusive of VAT, where applicable, for items located in the UK at the point of sale. Ebay used to only show the VAT at checkout for items sold by overseas sellers on ebay, causing much confusion, but that has now been changed and the advertised price shown is now inclusive of VAT:

When eBay will collect and remit UK VAT

8. How VAT appears to buyers:

  • All prices on eBay.co.uk will be displayed inclusive of UK VAT. UK buyers will see VAT-inclusive pricing when they view listings in search and on the listing page
  • Where eBay is responsible for collecting VAT on orders sent to a UK delivery address, this amount will also be shown separately on the invoices issued to buyers

Why? The VAT issue is EU-wide legislation and applies to all countries (and websites) in Europe, even those countries that are not in the EU anymore.

What happened:
We looked into your report and didn’t find the listing to be in violation of our policy. This determination was made using automation or artificial intelligence

NOW EBAY TELL YOU THIS

Charging VAT on eBay sales

If you're based in the United Kingdom or in the European Union (EU), you may have to collect VAT on items you sell on eBay. If you're not sure whether this applies to your sales, visit one the following sites, or seek professional tax advice.

If you're required to charge VAT on your items, here's what you need to do:

Not on eBay, but eBay themselves can add import VAT to the sale price if the item or the seller are overseas

This is IMPORT VAT and is charged on items you import into the UK from overseas, or items you buy that are located in the UK but bought from a seller located overseas.

The UK Government requires eBay to add VAT to items in these cases and the VAT is added on at the end. It is perfectly legal

What IS illegal is the seller attempting to charge additional VAT above the sale price on UK to UK sales.

Make sure you check which reason the VAT has been added.
