Warranties not hounoured by eBay UK

I have a FAULTY diesel heater 4 months old advertised with 3 year warranty, eBay think it is ok to close ALL returns stopping me from returning faulty goods for repair or refund. How is this allowed to happen in the UK should I go to trading standards?

It's the seller who is not honouring the warranty.   eBay don't get involved.   They only offer returns for incorrectly described items for up to 30 days.   You need to take it up with the seller and if necessary contact your payment provider about a refund.

There is nothing to stop you returning your faulty item for a repair or refund but you must negotiate this with the seller.

If it was a UK business seller, their contact details will be available on their listings.

Write to them or ring them and remind them of your consumer rights and their 3 year warranty.

The ebay MBG is ebay's bespoke buyer protection that gives you protection in addition to your statutory rights.  It helps members get a relatively easy solution to issues with sellers who use ebay.

 

That means that where you are out of time to use the nmoney back guarantee and therefore need to use your statutory rights, they are nothing to do with ebay and have to be persued independantly, possibly through your funding source.

The seller is not responding and eBay are not enforcing the returns policy or indeed the warranty. Ebay are complicit by doing noting to help when the seller will not play ball.

Have you written a letter to the seller and sent it using a signed for service?

Have you rung them up?

 

You are in the same position as you would be if you had bought an item with a warranty from a shop.  You have to be proactive and ensure that the warranty is honoured.

eBay protection is in ADDITION to your consumer rights

 

You still have all the consumer rights as if you had bought from a seller who is not on eBay

 

You need to deal directly with the seller, yourself

 

eBay offer 30 days buyer protection in addition to your normal consumer rights. eBay do not offer warranties, or offer to enforce warranties, you have to use your consumer rights to obtain your refund. 

 

I am surprised that you think eBay are responsbile for enforcing the third party warranty when they did not at any point offer this. They simply offer an additional protection level above the usual legal protections you have. 

 

You can take the seller to small claims court for a refund (he will pay the court fee if you win). Download screenshots of the listing before it is removed, and send the seller a "letter before action" (free templates online) before filing at small claims court. In my experience, they often pay when you send the letter before action and it rarely gets to SCC.

Was that a store warranty or a manufacturer's warranty? You didn't state! If it's a store warranty, then that's between you and the seller, if it's a manufacturer's warranty, then you needed to have it registered with the manufacturer and you'll need to deal with them, either way it's not eBay's issue to deal with.
