I lodged an official complaint regarding incorrect VAT collection by the IOSS operator eBay Europe S.à r.l. (IOSS ID: IM4420000742).
I purchased an investment gold coin (1989 UK Double Sovereign), which is VAT-exempt under EU Directive 2006/112/EC, Articles 344–356 and under Portuguese VAT Code Article 12.
Despite this exemption, eBay charged VAT at checkout.
eBay has refused to refund this VAT even after being notified of the error, and a PayPal dispute did not evaluate the VAT legislation.
As the IOSS intermediary, eBay is legally required to refund VAT that was charged in error.
I requested the competent european authority review this case and instruct eBay to refund the incorrectly collected VAT.
