I bought a Cintiq, and in the description it states touch and pen support. Now I paid, but I wanted to ask the seller beforehand just to make sure it had touch features. He replied back saying it didn't and was relying on the eBay description for the listing. I said he made a mistake, and I needed touch for my workflow, and so I wanted a day to have a think about cancelling. So the next day, and it was the weekend, I messaged him to say I wanted to cancel and didn't receive a reply back. It was until Monday, when I asked him if he received my message, and he said yes, but I need to cancel on my end. I said he should be able to cancel, as this was a mistake on his end and not mine. Then I contacted eBay for help via live chat and found out the seller sent the package earlier today at 1pm when I messaged him. So he wanted me to send him a request to cancel, even though he sent the item. and would decline automatically. Showing that I made the order by mistake, when the issue was with him?.
Where do I stand? Am I wrong in thinking this is really scummy behaviour?

So when it arrives, you raise a not as described case , the seller should send you a return label and refund once you post it back.
That the system nothing you can do once it has been posted.

I don't know why you didn't cancel it from your end and know it was done. If e-Bay had questioned you as to why you've got messages explaining that it wasn't as described and weren't just messing the Seller about.
All you can do now is as moldosgifts suggests above.

Remember folks, always ask important questions BEFORE paying. If that's not possible, try to cancel IMMEDIATELY.
