Hey, everyone!
So, on 18-Dec-2024, I placed an order for three times, each from a different seller. Two of those items arrived, but one still hasn't. The seller updated the delivery info on Christmas day and it showed that the item was dispatched (untracked) on 25-Dec-2024. The estimated delivery date is written as 27-Dec-2024. I am aware that mailing services can be slow during the holidays, which is why I haven't submitted a report yet. It's 10-January-2025 today and I wanted to know what's the best course of action, should I contact the seller first, or just report it? Should I give it a bit more time (like a few more days)?
This is my first time dealing with something like this and I haven't had any issues with my other purchases.
Would really appreciate your guidance!

When you start a not received case the first thing you do is send a message to the seller. However they reply remember to escalate to ebay after 3 working days to get a refund. I would start that now. You have between 3 and 30 days to escalate so plenty of time to wait longer for the item if you want.

Simply open a not received case straight away with ebay - the seller can refund or replace with tracking and if not ebay will force the refund - you have to wait three days to escalate to ebay
Be aware that sellers may try to persuade you to wait / close the case with loads of promises -
be courteous but do not close the case unless you have received your order and if a replacement is sent - do not believe it unless it is tracked - and the tracking shows it is on the way and again do not close the case unless it arrives in a couple of days -
escalate to ebay as soon as is allowed or before the case times out - do not be convinced to leave it open with loads of excuses - the case will time out and then your money is gone and you cant claim twice

So, just to be clear, I see that there are two options, "I'd still like the item" and "I'd like a refund" and if I select the first option (I'd still like the item) but it turns out that the item cannot be replaced (for whatever reason), will I still be eligible for a refund?

You can choose either now and still escalate to get a refund later. You could select that you want a refund but say in your message to the seller that you still want the item, just in case they haven't sent it yet (even though they marked dispatched). Either way escalate when you can to get a refund.

As previously stated you can choose either - normally I would advise contacting the seller first BUT because of the amount of time between estimated delivery and today - it would in this instance be better to simply open a INR case - to ensure you will not be run out of time to claim.
The other consideration is that without tracking you have no proof that the package has been posted or not merely a seller saying it has - they may be honest, they may not - who knows ?
Once a case is open you can correspond in that case and the seller can send a replacement and add the tracking to give you peace of mind if you want - they have 3 days to get it to you before you can ask ebay to step in and if a replacement is sent with tracking ebay will defer closing the case to give the package time to arrive - if it doesn't arrive within the carriers delivery aim you can get a refund - if it is delivered the case will close - no problem for either of you.
However the dillema is if the seller says they will send a replacement untracked - problem they have 3 days for it to arrive before you can ask ebay to step in and refund.
The seller will rely on you closing the case if it arrives without tracking.
Personally if the seller claims to replace with no tracking and you agree -DO NOT CLOSE THE CASE unless it arrives and given the amount of time you have already waited I would only give them a few days for it to arrive again - no more - no less - that is perfectly reasonable -

The maximum time allowed to escalate is 21 days not 30.

Hi! Just wanted to give everyone an update. The seller responded later in the day and said:
"Hi sorry to hear the item has not arrived to you. Luckily I have a box of these games sealed so I will send out a replacement to you today- it’s sealed new exactly the same as the previous one ordered "
Following all your advice, I kept the request/case open. I have to wait till 16-Jan before I can ask ebay to step in. Hoping I actually do receive the item before then...

Hey! Another update: Finally received the item today. I opened the envelope and the item appears to be in a good condition (haven't unsealed it yet as I don't plan to use it immediately). I'll be closing the request/case now that it did arrive - in one piece.
