I don't believe that the seller has the item that I bought / will send it to me

The item has been "Awaiting Dispatch" for over a week.

More concerningly, the seller, who has 0 Feedback, "silently" cancelled one order, and never sent another...

The item never sent was similar (the same?) to the one I bought...

Ebay tells me that I have to wait until October before they can intervene.

Surely, there must be a way that I can get my money back before then?

If you look at the item you bought (not any live listing as that will only show the latest estimated delivery date,as if you bought it now).What is the latest estimated delivery date ?.

October doesn't sound right.

Item bought 7 September.

Item still "Awaiting Dispatch".

Seller does not respond to my messages.

This in the context of the one buyer who was "silently" refunded (their words), ie refunded without an explanation, and the other buyer who never received his item, and never heard from the seller again.

The item I bought was the same as the one that the one buyer never received.

My time in the Police and working in Court, tells me that either the seller is a fraudster, or that he has "problems"...

Ebay, to whom I have reported the matter, will not intervene before 16 October, which is less than satisfactory in the circumstances.

You said the seller has no feedback but you mention feedback which has been left for them.  Is that feedback from more than a year ago?

You were asked about the latest estimated delivery date.  That will be in the email you got from Ebay when you paid.  Can you share that date?  That would help explain why Ebay won't step in until October.

Where is the item being sent from?

Essentially, once you place an order and pay for it, the seller has to have time to get it to you.  One day after the latest estimated delivery date, you should be able to open a case for 'item not received'.

You do need to look carefully at feedback comments, location of item and particularly, estimated delivery date before you buy.

While I normally accept long delivery times, I wonder why an item is still "Awaiting Dispatch" 9 days after purchase, and why there is no reply to my messages (they don't understand English?). And why the previous "no shows"? Certainly a prima facie case...
