So an item turned up and it was not as it should be, seller has accepted the return and sent postage label (thanks to those that told me how to get that bit sorted), so will I get a full refund or do I loose out on the buyer protection fee, might sound stupid, but I thought we were covered on this sort of thing by using PayPal or our own credit cards, so,is this a bit of an eBay scam or not. Just wondering.

As advised you will be refunded in full including the Buyer Protection Fee. That is actually a legal requirement.
The Buyer Protection Fee isn't exactly a scam but the way it has been advertised/marketed makes it very unclear as to what it actually relates to or how it differs from eBay's Money Back Guarantee.
Whilst purchases are covered by PayPal and card issuers that protection is completely separate to any provided by eBay and is actually more costly to eBay if used so it is in eBay's interest to provide their own.
