You only have 30 days from the estimated delivery date to start a "not received" case to get a refund.    If it's past that time it's too late to do anything about it on ebay but contact your payment provider and see if they can help with a refund or chargeback.

I think you need to read what you have been told. It is NOT Ebay staff answering you but other members giving you advice.
