Returned an item and seller won't refund me

I bought some lego as new and unopened in listing, When it arrived it had been opened and box was very damaged. I returned at my cost and seller has received but they won't send my refund. I think they are waiting and hoping I will get refund from Ebay or Paypal so they get their money and item. What do i do??

You don't get a refund from Ebay or Paypal if they have to make a refund it comes from the seller. Ebay isn't a Charity.

 

Did you open a  case?  If so if you had opened a  not As described case the  seller would have had to provide a  Reply Paid Return Label. 

 

If you did  open  any sort of case, then  after 8 days you escalate to ebay who  refund at the sellers expense and they get no refund of the selling fee  but do get  a  Damaging Defect on their account.

 

On  every listing top right ebay put the  Money Back Guarantee,  it just seems that   no one reads it  as buyers are so well protected that they can't lose money if they just follow the instructions.

 

If you said what you had actually done it would be possible to explain what if anything you can do to sort out the  mess and force a  refund.

The only way to enforce a refund from  an unhelpful seller after you receive an item not as described,  is to open a case for this in the Resolution centre link at foot of most pages.

 

The case would have enforced the seller to pay for that fully tracked return postage,  as you have now paid for this yourself,  there is nothing to do, to make the seller refund this.

 

Enter the tracking number of the item you returned into the case details,  it gives the seller 48 hours to refund you.  If they do not,  escalate the case,  eBay step in and fully refund you,  minus now that returned postage cost.

You've been an ebayer for over 16 years, so I'm not sure why you went down the DIY route instead of using the tools that Ebay supplies, and in various places too.

 

Not sure either why you think that Ebay and PayPal refund buyers from their own coffers and let sellers off scot free. Smiley Frustrated

 

No-one can tell you what you can do, if anything, as you haven't provided any information (dates, whether or not you returned with tracking, and so on).

 

So that you know what you should have done (ie. opened an Ebay case or return request for Not As Described, in order to receive a tracked returns label at the seller's expense, and so that Ebay could force the refund when tracking proved delivery or attempted delivery back to the seller), read Ebay's 30-day Money Back Guarantee, which is on every listing, and in various other places across the site.
