Conflicting details in the listing, where do I stand?

I won a bid for a DVD that states its Region 2 in the item details. It came up in a search because Region 2 was one of my search parameters.

But in the listing details it says some discs are region 1, which I can't play. I've contacted the seller and asked them to retract the bid and offer it to the next bidder, can they refuse or do I have to buy the item?

(Yes I know I shouuld have read the entiore listing before I bid, thats not what I'm asking about.)

Now that you have won, have you paid?

It would be in the sellers interest to cancel before you pay, but he might go for the Unpaid Route to get his selling fee refunded.

If he did this you could pay and on receipt I thnk it would be fair to open a Not As Described Case, the seller would have to provide a Reply Paid Label and on return refund.

Cancelling before payment would save the seller quite a bit of money  but whether he will see this I cannot say.
