Fake Licensed Party Items

How are  sellers getting away with selling the cheap unlicensed party items .  Ebay is flooded with the imports from Shein , Ali Express  . They have not passed UK Standards and they are breaking all copywrite regs. How is Ebay allowing unbranded items  where they have not paid for the copywrite. One seller is selling  Gabby's Doll House and saying its made by Procos and it the rubbish they are selling on Shein.   Watch Dog did a test on these products and they are using inks that are not safe and people are eating and drinking from these items. No wonder the UK Main Party Distributors have gone into administration

With over 7 billion listings on at any one time,  it's impossible for eBay to check each and every one,  and they do want the help of members to report anything on listings they believe breaks eBay's selling regulations, there's a report ? mark bottom right, of every listing,  to lead to a page to report that item.

 

I know many reading this will say ' waste of time' we've done it and nothing's done!  Yep, I'm sure every report is not acted on, but some take time to investigate and eBay will never come back and explain any, if any action,  was taken.

 

Another thing you can do if you know a copyright is being copied without the Brand owner's permission, contact the Brand owner and report the listings to them.

 

eBay do act on the number of returns for item not as described received, if there are too many, it brings a red flag to eBay and they can then act with selling sanctions even bans.

eBay does not police their platform as a rule. When it comes to items that are counterfeit and/or dangerous eBay only listens to the following parties:

 

  • The Office for Product Safety and Standards who can take dangerous listings down without involving eBay
  • A rightsholder such as the owner of a copyright, trade mark, design right or patent that is being infringed. The rightsholder needs to file a notice of claimed infringement (NOCI) under eBay's VeRO Programme 
  • Buyers opening return cases selecting the "Doesn't seem authentic" reason. Too many of these and eBay takes notice.

 

eBay absolutely does not listen to sellers who are reporting other sellers.

Give me ambiguity or give me something else.

Im afraid this isnt just an Ebay issue - We can buy from Shein, Ali Express etc ourselves and we hope that it meets regulations (which it should do for regs) but you are presuming that they arent meeting standards and are breaking copyright laws - What proof do you have that they are?


If its copyright laws then its up to the license holder to challenge their copyright being missused, not for Ebay to ask for sellers to prove that they have the rights.  This could be a minefield if a 3rd party (ebay) took this upon themselves to check who has legal claims to copyright items, all they can do is ask companies to join VERO and then these will be monitored   

 

Im guessing from your shop name that this is particularly frustrating to you as these are competition, but all you can do make sure you are compliant and report others (maybe trading standards if you have proof of any laws broken)
