Ebay forces upgrade to Business due to new HMRC regulations

Hi All.

I've received an email from ebay forcing me to switch to business account due to the volume of my recent sales. Customer service explained that I exceeded £1800 in one month, so they act in line with new HMRC regulations. The email is a bit threatening: "We need you to make these changes to your account within the next 21 days. If you don’t, your selling privileges may be blocked. This includes listings ended and loss of selling history."

However, As I'm not ready to go business and I consider my increased activity as temporary, Customer Service advised that if reduce my sales volume, I can stay private. Has any of you passed through this process?

Also, what happensto your existing promo listings if you switch to business? Are they allowed to continue on promo terms and with 'no returns accepted' until they sell or end?

What's killing businesses is their owners don't spend enough time looking after them, instead, they browse other sellers' listings and try to calculate how much they saved on insertion fees.

I agree with the comment about private sellers being actually asked due to their turnover at ebay to follow the guidelines and rules set by HMRC, as it is oftne business sellers sales can be damaged by so called private sellers who walk away from the obligations on distant selling too.

 

I am a sole trader, have two different business running while when setting up another family member recently the criteria to declare self employed was based on turnover not more than £1,000 bear in mind if on PAYE too you may have used up all your personal allowance, then there is £242 per week with regard to National Insurance too.

 

Some business traders sell on many platforms so its not just ebay, the seller may well have a much bigger overall turnover, (less costs etc) regardless of income. So too the level for VAT, its the turnover figure not taxable income or gross profit.

 

Final thought, ignorance is no defence, HMRC have it all thier side and if no proof of trading expenses you can get hit with fines and back tax up to SIX years.

Does Business Name need to correspond with bank account?

It's currently showing my name and as long as I'm trading as sole trader, I shouldn't change it to anything else, is that correct?

I have also heard that they are not just sending HMRC the year 2024, they are sending HMRC all your sells from when your account was opened.

Sorry but you are a business . Your are trading to make a profit . I would quickly register with HMRC and you will be contacted by them as they will want to see previous years trading accounts to see if you owe back dated tax. This will depend on what your payouts have been from eBay which HMRC will now have full disclosure so I would suggest you quickly register as a sole trader and disclose your income for at least the last 2 years. Failure to do so you will get an HMRC investigation on you which I would try to avoid at all costs. Just simply register disclose your income and let HMRC decide what you owe in tax and pay it if you actually owe anything . If you don't then you run the risk of being investigated and fined . Being upfront with HMRC is the best

HMRC would not be able to cope with that amount of data. ebay's customer services agents have been putting out some wrong information in this area and what they say has to be taken with a pinch of salt. ebay will give a complete sales history if requested by HMRC, but all the information I've seen so far suggests our data will ordinarily be sent to them from Jan 24 onwards.

HMRC may have new software, but still would not cope with twenty plus years of selling on ebay plus all the previous data from the likes of Amazon, Etsy, Vinted and the like all in one go. HMRC will ask for further sales history if they suspect a error or fraud.

Agreed. If they were that advance with super software, the first thing they'd do is update to website and filing process. It's so.... 90's (well maybe early 2k's). 

 

They'll go by algorithms and under declaring which is a bit of a pain with eBay because say you had a turnover of 50k 1 years, and 15k taxable profits. The next it could be 60k turnover but only 14k taxable profits (thanks to eBay not doing a fee promo for businesses that year or increases in fees or postage). 

 

Any new software isn't designed for this super computer stuff. It's just to detect anomalies in what's declared or what isn't from this year. Although if they suspect something dodgy, they can ask for backdated proof prior to this year. 

 

Around 10% of audits are random. I read somewhere it's 1 in 40 (might have been 400, can't remember now) chance of a random audit. The rest is tip offs or HMRC software suspicions.

We all know how good any super computer is when its purchased by the government.  

 

Its a bit like the TV detector vans which have been around since the 1960s yet in all that time up until now they have not had one single prosecution  .

I see you still have enough time to spy around. Yes, I have no active listings, as I've received 30-day ban on my business account for placeholders and all my active listings have been ended. All of those placeholders were about to be deleted anyway shortly and I didn't really gain anything different than pennies, definitely not put other sellers in disadvantage at all. As ebay doesn't check it on their own (I have been using placeholders in small volumes for months), I guess someone from here must have reported me.

I was stuck with stock, so I had no other choice than to move temporarily to my backup private account that I was using for purchases only, certainly on full fees. To my surprise, sales restarted quite promising, even with no sales feedback. And after only a fortnight I received my first 80% FVF Promo today on that account. So if it was you who reported me - well done and thank you.

You had a choice,  you could have waited out your ban and then continued to trade legally on your business account.

You miss the point businesses are angry becasue they don't receive the 80% off fees offer. They dont get any  offers.

And this folks, is what gives Ebay a poor name. So when you buy your new trainers, make sure you are buying them from a reputable business seller who conforms with Distance Selling Laws.

To the OP - I hope you have changed your name, address and bank account for your private account as you have already been warned by Ebay and if they link your account, you may get a permanent ban.
