Damaged goods

I have just recently purchased a brand new gazebo. Upon opening and inspecting i have found 1 of the side panels is damaged its stained and cannot be removed. Ive contacted the seller and there being very difficult as regards sending me just a replacement panel

You did ask about this on 17th April.

The seller does not have to send you a new panel.

They can offer you a partial refund or a full refund on return of the item.

Those are the terms of the Ebay Money back guarantee.  You cannot make the seller do anything else.

It is always better to return item than ask for a replacement,which you wouldn't be covered for,so open a return request for item not as described,and the seller should send you a prepaid return label and refund you within 3 days of getting the item back.

 

Don't let the seller run you out of time with false promises,and get you to close the case as they can't be reopened,simply escalate the case to ebay within the 30 days of opening if you get no label or refund
