Well as ebay accept attempted delivery as delivered, then nothing really seller can do. If he opens a not received case it should close in your favour.
Even if returned to you, any refund should in my opinion, be after deducting the postage cost.
You do say the address the buyer provided, I hope thst was the same address provided by ebay with the payment details.
