Your post is rather confusing as you keep referring to the buyer as the seller.
What case did you open? There is no case that a seller can open with eBay until the item is returned.
If the buyer is now refusing to return the item then, unfortunately, there isn't a great deal that you can do. Have you offered to send them a prepaid return label?
