buyer sent a completely different item back and has been given a refund

Hi could you help i sold a Monler coat to a buyer  it was delivered and signed for by warner i have picture of this as soon as the lady received it she falsly claimed the item wasnt as i desribed ,saying it was smaller than a 14 as i l;isted and sent me pictures of a lable 10 you can clearly tell from this picture she sent that this is a different coat to the one i sent  by the colour of the lining and size    ,i also have both pictures .The buyer said the coat had a;so been worn but it hadnt she claimed it smelt it most certainly didnt  but the one she sent back to me did .

The  lady requested a refund were i got billed for the delivery  and she kept sending me messages asking were her refund was  even one had a laughing face on||||  i also i have pictures of this  i explained i hadnt received it yet as soon as it come i would give refund .

Anyway the coat arrived and as soon as i saw the parcel  which looked extreamly small  opened it and she had sent a competely different coat back age 10 not 14  totally different colour  totally diffent size . she obviuosly had this in mind to do from day one by sending me pictures of a smaller labl;e.Scammer||| also in the pocket was a buisness card which i have kept and to my disgust was a used tissue with snot and blood on absolutely disgusting ||||||| i also have pictures of these .

I have tryed to contact the buyer  numerous times to either send me  my coat undamaged(which i dont want now i want the payment) and i will return her coat on completion of payment i am still waoitng reply from days ago .   the coat she sent me probably isnt even genuine.i have kept all labels from her coat she sent me 

I opened 2 reveiw reports with ebay  for falsely claiming the item wasnt  as described and for returning a completely diffrent item back to me  this has been acknowlged by ebay on  2 april but i havnt heard anything alse  this is a fraudulant claim and if its not resolved i have no choice to go to the police .

I'm sorry this has happened to you. But Ebay have no idea what you actually sent or received back, or what condition it was in when sent or received back, as they were not present when sent or received back, so have no choice but to accept a buyer's word for it when they claim Not As Described, and ensure that the buyer is refunded in full when tracking proves delivery or attempted delivery back to you, as per their Money Back Guarantee.  They cannot get into disputes between you and a buyer.  Only a judge can decide if a buyer is a liar or scammer.

 

You agreed to comply with the MBG when you registered your account. To avoid damaging account defects, you have to agree to return-for-refund, and generally refund in full on receipt, regardless of what you receive back. If you don't, your account suffers when the buyer escalates the case or return request to Ebay. You then report the buyer to Ebay for abusing the MBG by fraudulently claiming Not As Described etc (via the 'report' button on your ‘leave feedback’ page). A few of those from different sellers, and their account will soon be toast. And add their Ebay ID and PayPal email address to your Blocked Bidders List so they can’t darken your doorway again.

 

This may sound unfair, but it's the fairest it can possibly be.  The MBG is a very good thing (although you may not think that at present) as it gives buyers the confidence to shop with you and every other Ebay seller.  Without it, you'd be lucky to sell anything at all. In fact, without it, Ebay would no longer exist.

 

You can then deal with the fraudster outside of Ebay as follows:

 

Send them a PayPal invoice to cover your losses, giving them 3 days to send cleared payment or you will be taking legal action and reporting them to Action Fraud (the police's online fraud unit).

If payment is not received within that timeframe, send them a 'before action' letter by Signed For post, giving them 7 days from receipt to make full and cleared payment, or you will report them to Action Fraud, and take them to Small Claims court to recover your money and all court and other costs.

If payment is still not received (unlikely, as this is generally enough to put the fear of god into small-time fraudsters), take them to Small Claims court if you wish.  Very easy to do, and the process can be started online.
