I have to write this on the public forum to present to the public how ignorant and deceptive Ebay staff really are, they honestly don't care about sellers.
We sold an open box top of the range motherboard for 500 to a Croatian, which I would highly recommend to Never send anything to Croatia, disgusting tactics.
He tampered with the board and sent in pictures admitting to dismantling the item, which he ripped a backplate thermal pad on the back part of the board.
He used clear extortion tactics to attempt to charge me 70 Euro for essentially a 6 Euro thermal pad.
I contacted Ebay which over the phone to an agent, this is recorded also on my side, he agreed that the buyer is using extortion tactics, then stated you have 2 options, either pay the 70 or issue a return label. I then asked could I try and offer a reasonable price for the thermal pads seeing as the exchange rate in Croatia is through the roof, he clearly stated which I have all the evidence, Ebay stated ''If you cannot resolve the issue with the buyer then issue a label on the 10th Aug or no later than 8AM on the 11th Aug.''
You see we had the case stating ''Closed on the 11th Aug'' So this conversation was on the 7th Aug, I messaged the buyer with a reasonable offer and waited for a reply.
The next day, all hell breaks loose. We checked our emails and Ebay without our permission or clarified this, closed our case not on the 11th Aug obviously, but closed the case prematurely on the 8th Aug, allowing us no time to issue a return label. Ebay outright lied to us as they instructed us to resolve the issue or provide the label on the 10th Aug.
Ebay charged my bank 500 which put me and my family in the red, in debt to our bank with bank charges. Paypal held our funds so we had -500 with no actual funds from the buyer. I contacted Paypal and issued a fraudulent case upon Ebay and provided evidence showcasing Ebays deception.
For the past 20days we have had over 11 Ebay agents stating they mishandled the case and will issue a full refund within 48 hours, which 2 days later, no update, no refund, we then contact Ebay over and over again as they state, 'We have to wait 48hours for an answer from the back office' This apparent back office I believe is the deception, there is no quote back office dealing with these types of cases, just lies and deception from this scum company.
They now refuse to issue the refund stating, that there is no evidence of me issuing a return label? How can this be logical? Ebay closed the case before we could even issue the label? Again not only deception but its, illogical.
We have substituted enough time for Ebay, we have now provided Ebay the final warning, that if they do not issue our full refund within 72 hours as they themselves stated, a formal letter will sent after 72 hours to pursue legal action, which they reply the same generic deception statement of us not issuing the label?
Ebay also stated to not pay the invoice until you recieve the full refund even though Ebay sent us a threatening email 'THE HEADER WAS ALL IN CAPS LIKE THIS' stating Paypal denied the payment for the invoice, well Paypal denied you, Ebay, over the fraud that you committed.
So I also payed Ebay the invoice because they will obviously use that in court so I have done as instructed and payed them the invoice.
Ebay seems to ignore our warnings over and over, I have stated this by phone, email, and live chat, I have all the evidence of the Ebay recordings, I have spoken with our legal team, they stated, Ebay haven't got a leg to stand on.
I hope this helps any new sellers with any answer to selling on Ebay, don't use this service, they are deceptive scum that lie regarding your case date, close the case prematurely and charge your bank with out permission or clarification. Left me and my family with no funds. Absolutely disgusting.
i`m afraid from a legal point of view, your unlikely to get much help from here regarding that, because non of us here can give legal advice, so the only thing you can do, which you`ve stated you already have, is to seek legal advice and go from there.
The biggest problem i think is happening here, is that each time you `talk` to Ebay through `live` chat or on the phone, your only talking to agents who sit on a laptop somewhere in India or something, who will just tell you want you want to hear and are frequently handing out poor advice, so you need to talk to someone `higher` up the food chain who could deal with it better, perhaps this is something your legal team may be better at acheiving i assume.
Other than your legal routes, i`ve heard alot of good views on this website about resolving issues like this, so they may be worth a try;

This is our public statement, we are not writing to request legal advice but to showcase Ebays deception and manipulation handling put forward cases, which is a shame.

Well, this is the ANSWER CENTRE after all, so I'm not sure why you would post here if you weren't looking for answers. When you're not looking for help, the place to post is Seller Central in the Discussion forums. Though why you would post about your legal suit against Ebay on Ebay's forums is a mystery.

Does your legal team know you are posting here on eBay boards and the implications?
I'm not sure if this is the correct time to discuss matters regarding a possible legal action against a huge company.
The only advice I think members can give is for you to seek correct legal advice from a solicitor who will look at your case and evidence you have gathered.
My only worry is that you need to win the case in or out of court to cover your losses on the sale, but also your legal fees in persuing the case.
