I sold an iPad as Opened - Never used. Ebay states that this doesnt have to include the original box and accessories. The ipad is indeed new but minus the box, and the box was never in the listing pictures or description. the buyer is now harassing me to send him £40 for boxes or claim item not as described

I would just get item returned and refund on receipt. They are probably trying it on, even if they open a case as item not as described you will be fine, it wont affect your ratings once you have refunded and Ebay will advise you to wait until item returned.
Check your original ad and call eBay - if its states no box etc then buyer will have to pay own post cost to return it - i had someone claim item not as described but it was very clear in the ad - I refunded BUT they had to pay post to return ...only refund once item received by you.
Alternatively you could offer a partial refund and let them keep item - I really wouldnt be held to ransom on this and i certainly wouldnt be buying bits to send the buyer
Basically - partial refund (amount YOU decide NOT them and ONLY IF YOU WANT TO ... or ... return for a full refund ... end of discussion, its xmas shopping time - you will easilly sell it again anyway !

Do as @traceirelan0 has advised and ask them to open an ebay case, accept the return, and refund on return.
You will have to send a prepaid label within the case but you don't refund until it has been returned.
You can report the buyer then, for abuse of the MBG, sometimes ebay gives you your postage fee back, but you cannot guarantee this.
Did you describe it as "new" or "new other" as there is a big difference.
