Buyer claims laptop is faulty after nearly 2 months even though it worked fine when they received it

I sold a laptop on the 7th December, all working fine, just had a couple of dents/scratches which I showed on the listing.

Buyer received it on the 9th and sent me the following 5 days later.

I was wondering if you've noticed any issue with the hinges at all? They creak when adjusting the position of the monitor and they feel like they're somehow... resisting? at the same time. It's more noticeable when trying to adjust the monitor ever so slightly.

Other than that I'm happy with the laptop, it seems to be working very well! It's just that I've looked up this issue with the hinges and others owning the same laptop aren't complaining... (nor is it a common issue with this laptop model).

The hinges were on the stiff side but not so as to cause any problems so I hadn't even thought to mention it in the listing.

I apologised and explained they weren't a problem and I didn't hear anymore.

 

Then today, over 7 weeks after the original sale date, I received this via Paypal Disputes.

 

Hello, Thanks for sending this laptop, but I'm afraid it's not as described (not in 'perfect working condition' AT ALL). This laptop does not work properly.

 

The biggest issue is with the video card. I've had it checked by a specialist and according to him the video card has been 'reflown' (in his words, the video card was 'baked' in the oven to temporarily fix it). Also according to him, reflowing a video card is a temporary fix that lasts a very short period of time (i.e. a month), so if you're selling the laptop the customer won't immediately know there's something wrong (and when they do, the returns window would have expired). I am not happy about this as I bought a laptop that's supposedly in 'perfect working condition' when it isn't, the seller has clearly attempted to sell me a damaged laptop and mask the issues with the video card so that I wouldn't be able to return it.

 

Additional issues: 1. The microphone and camera keep disappearing from the Device Manager (i.e. can't use them at all) until you restart the laptop. 2. The sound doesn't work at all sometimes, unless you restart the laptop. 3. Startup issues: when I power on the laptop, sometimes the screen stays black and nothing happens (although you can hear the laptop is 'on' and the buttons/light indicators also light up). 4. Battery doesn't last much and needs recharging very frequently. 5. Freezes regularly, even when there's just Chrome that's running and nothing else (right after it goes back to normal, there's significant mouse lag going on for 20-30 seconds as well). This laptop is definitely not in 'perfect working condition' as advertised in the eBay listing. I'd like to return it for a full refund. Thank you.

 

The laptop worked perfectly when I sent it, and apparently was working fine 5 days after they received it.

I'd bought the laptop back in March and not had a single issue with it in that time, and certainly hadn't tampered with the graphics card. I had upgraded the RAM and added an SSD but that was when I first bought it so had a few months using it like that.

 

Where do I stand with this?

I've heard so many times that Paypal/eBay always side with the buyer but surely the fact that they acknowledged it worked fine when they received it should count for something?

 

I have asked how the 'specialist' came to the conclusion about the graphics but I'm still waiting for an answer.

PayPal don't Rubber Stamp Returns like Ebay do. They look into Cases much more thoroughly. I would doubt after reading the Buyers Catalogue of adjustments and how he sent off the Video Card to a Specialist is enough for PayPal to find the Case in your favour. PayPal only Refund for Items which are found to be faulty on Delivery. Not weeks later.

Reflowing is unlikely,but someone must have opened the laptop to look at that ,so as its been opened it would void any warranty if you bought it in a computer shop,so i would hope it voided it on ebay as well,but you never know.

7 weeks later is too late for ebay,but how paypal will deal is unknown.

You’ll just have to wait and see what PayPal determine. If they allow the return, the buyer is responsible for the returns postage fee.

If you’re feeling generous you could tell the buyer about the free returns scheme run by PayPal - whereby they can get the return shipping refund up to £15.
