Buyer Advised brand New sealed item did not have game inside

Hi All,

I am a new to the ebay selling platform. I used to strictly be a buyer but wanted get better value for some stuff. I recently purchased Zelda Breath of The Wild brand new factory sealed with receipt. I changed my mind about playing it and decided to sell the product on ebay unopened.
I applied bubble wrapping to give the game extra layer of protection and posted the item for sale.

Having successfully sold and dispatched the item as soon as possible. I woke up the following day to this message from the buyer who purchased my game.

Hi I received my purchase of Zelda breath of the wild switch but there is NO GAME INSiDE THE BOX whats going on where did you get it, as I am not happy at all my son opened it in front of me he took the wrapper off opened the box and it’s empty nothing inside at all , it’s as if someone has removed the plastic wrapper and took the game cartridge out then put the wrapper back on , this needs sorting out , my son is very upset.

Having seen this i know this is completely not true and the buyer is not deserving of a refund. Beside i have stated in my listing that there are no refunds as I have sent him a factory sealed product.

I believe I also may have been targeted as i am a seller with no feedback.

I am new to ebay and would like feedback on ways i can combat this problem.

If you didn't oen the game yourself how can you be 100% certain the game was in the box.

You need to get the item back and refund your buyer in full, no returns on a listing means nothing. 

Your legal obligation is to make sure the item description matches the item, and in this case it obviously did not.

The item was factory sealed from a known respected game shop in my area. I have purchased most of my games there for over 10 years now. Me removing the packaging to check if the product is in devalues the product. Meaning i will need to sell it used. It defeats the purpose of brand new.

How are you sure this seller isnt a scammer and is not trying to pull a fast one on an inexperienced seller.

Its in my best interests to protect myself hence why i have come to this discussion board.

Going forward i may just open up products and sell them and describe them as Like New so i can showcase and ensure better protection.

You have no way of knowing that game was inside or not,
neither can you prove buyer has scammed you, but ebay always believe buyers.
You will just have to refund on return or without return.

I know for a fact the game was inside because you can hear the cartridge move inside the case. My only form proof is my receipt for the product and its condition before the product was sent.

If this is going to be a loss so be it, i want to turn this into a lesson.
Can someone please advise how one can mitigate the problem going forward?
