Selling on ebay under 18 yrs old

My son registered an ebay account, and posted his phone on ebay for sale, and it got sold straight away. Since its a new account, the payment is on hold for 7 days. Just before he was preparing to post/send his phone, he realised ebay asks him to upload passport ID to prove his identity. Then he came to me and I realised that he is not 18 yet, so may not allowed to sell on ebay. 

What should we do in this situation? if he sent his phone to the buyer, but when upload his passport ID then ebay realised that he is not 18 years old yet, would ebay relase the payment to him? or should he just not send the phone so the buyer will get the money back and he doesn't lose his phone?

My kid has a similar issue.

when she opened a eBay account, she was not aware that there is a clause requiring the account to be opened by someone 18 and above, despite she has entered her year of birth which clearly showed that she was below 18.

 

a transaction was made. Buyer received the goods, eBay asked to verify id, we spoke to the agent and said she was not 18 and cannot provide a driving license, the agent said it was ok, just send them something to verify her identity.

 

id provided. Then eBay informed my kid that the account is suspended. Therefore, can’t log in, can’t read mails, yet eBay holds the money from the buyer.

 

since buyer already paid for goods, is there ways eBay can be contacted to:

 

1. release the money

2. why didn’t the agent say, or reiterate the u18 clause

 

any help would be appreciated.

I'm about to be in this situation, expecting about 5-600 pounds worth of payment, ebay has randomly asked me before my funds are released even though I've sold months before, why now?

Do you mean you are under 18, or just that ebay is doing the KYC checks?

Ebay is currently doing the KYC check on me, and I am under 18, at 17 years old. I've sold a good few valuable items, delivered, gotten the payments/ funds etc. Recently sold a pc and was waiting on the funds until they gave me this check today or yesterday. The PC has been delivered and have a few more orders after that. 

 

I haven't confirmed my details yet.

As you are under 18 you are selling in breach of eBay's User Agreement so, unfortunately, now that eBay has asked for ID there is no way that you will be able to receive any further payments. 

 

If you provide ID showing that you are under 18 then your account will almost certainly be closed and you will no longer be able to sell on eBay in the future.  How long is it before you turn 18?

 

I would suggest that you end any active listings and cancel any outstanding orders whilst you still can.

You may not get any further payments.  I am not sure ebay has any legal obligation to you as you are too young to enter into a contract with them.

I just recently turned 17 so next January. 

Would I be able to get my dad to add me to his account, would that work in any way? Or no.

So even if the delivery was confirmed, would there be any other way to transfer the funds to one of my parent's accounts?

No, there is no way to do that unfortunately.

It might be 180 days,  no-one in your position ever tells us what happens, but as I said, the legal position for you is different.

No, ebay won't do that.

You might get payment after 170 days if you are lucky but if eBay believe that you have acted fraudulently for any reason then they have the right to withhold funds indefinitely.
