Hello just wondering if I could get some advice on what to do? I sold a 4060 Ti graphics card on ebay for £320 and the seller was saying it was faulty even though it wasn't, he filed a INAD return 2 weeks ago and I still haven't received it back, even after messaging him.
I was just browsing through Facebook marketplace tonight and I found the exact item up for sale using the same picture in the return info and the exact name as the buyer for £350 and in the description "perfect condition, great GPU"
Can I screenshot all this info and send it to ebay to get it closed?
P.S. I haven't sent the refund yet if I need to state that, just my funds are being held until the 23rd January

Did you send a returns label through the case? You should never refund without getting an item back so its good that you have not refunded yet.
i would not get Ebay involved in the case at this point as they have a habit of siding with the buyer once involved. If he does not return it in the time allocated, the case will time out and your funds will be released to you.

He may have another and just used your description and photos, this is not against the rules.
Opening a case for INAD accept it within 3 days, and pay for that fully tracked return postage, the buyer Must send your item back before you refund them, then you have 48 hours to do so.
If they don't send it back after receiving that return label the case closes , and no need to return.
Whenever a case is opened payouts for the item are placed on hod until the case is finalised.

It seems likely that the buyer actually knows there is nothing wrong with the graphics card and is trying to make a quick profit while also holding you to ransom with an open return case.
The Ebay returns system is heavily weighted in favour of the buyer as we all know. However, for me, the worst thing is the time frames.
I have an open return at the minute.
The buyer opened the return for a completely fake reason - earrings she bought from me were 'not vintage'. Actually, they were. I bought them secondhand in the 1980s and one of the eras for vintage and antique jewellery on Ebay is 1980-1989. Anyway ...
I accepted the return on the day it was requested, January 2nd, and provided a label at the same time.
The buyer now has until 22nd January to send them back - 20 days, nearly 3 weeks. That leaves the whole system open to abuse. If/when I get the earrings back, I will have 48 hours to refund. It is taking the ... .

Anyway, after you have the item back, unless of course the buyer manages to sell it, report them to Ebay for abusing the Money Back Guarantee, that is probably all you can do.

Unfortunately it's just a waiting game now.
I guess your buyer is not planning on returning the card if they can sell it via FaceBook, but if they don't then they will, so they're hanging on in there.

They have got to send something back. I'd carefully video the initial unboxing of what is received back and ensure that whatever evidence is of FB marketplace is saved as PDF.
