false advertising by sellers

I ordered two wheel bearings from a uk seller and was sent wrong item so i set up a returns page with ebay and posted goods back. that was in oct, and then found out goods were being returned to china who claim they have not got them. ebay closed the return on oct 28th and are refusing to respond to my request of intervention of a refund. Should i take legal action against ebay or the seller?

Looking at your feedback it appears the purchase was over 6 months old so you are pretty much out of time to do anything at all by any means ,especially if seller is registered overseas.

 

Sueing Ebay/seller is pointless.

If you paid by PayPal open a case in their resolution centre.

They allow cases to be opened up to 180 days from when payment was made.

Make sure you escalate the case within 20 days or it will close automatically and you won't be able to reopen it.
