I have received a returns request for an item that doesnt work I listed as used and stated in description that it was untested buyer says I should have listed as spares or repairs should I just accept the return

Yes, if they escalate to ebay odds are they will find in their favour and have been known to refund without return.   So accept it, get the item back (assuming you want it back) and then refund.

As advised, you should accept the return and refund when you get the item back.

It doesn't matter that you stated the item was untested - Ebay defines a 'used' item as something that is working:
