Hi,
I'm looking for some help with an odd issue. This year I visited the New York Comic Con - it was my first time in New York and first time ever at Comic Con.
I was delighted when, while waiting in the queue at the eBay booth, I won a charity auction for a rare comic book. The auction was what they call "penny button mash", where prices were capped at $20, and people just had to continuously smash the buttons. During the live event, the presenters hyped that this was a valuable comic book being sold at a fraction of its standard cost and that it came with free shipping anywhere.
Once I checked out I got charged for shipping regardless and when I complained to the seller they said there's nothing they could do. I figured fine and let that issue go.
After many weeks, the comic book finally arrived and it was the standard version instead of the rare one. In fact, the one sent to me retails for about the same price as the shipping I paid to have it delivered.
I reached out to the seller hoping they'd help me out but instead they said they can only offer a refund but if the comic book arrived damaged I won't get anything back. Moreover, I was told that if I did request a refund I'd be taking the money away from the charity.
I feel horrible as I don't want to take money away from charity but also I've been clearly scammed (on stage at the eBay Comic Con booth no less).
Does anyone have any advice as to what I can do? I really don't want to hurt the charity but also don't want to be scammed. Thanks!

On eBay you can never force a seller to deliver what you ordered.
If an item is not as described all you can do is return it for a full refund of the price you paid.
I don't know how an "eBay booth" works or whether it's covered by eBay's money back guarantee in the usual way. If it is, open a case if you still can and ignore any bs that the charity will suffer. Be aware that you may be expected to return it to the US at your own expense.
If it's beyond the time limit there's nothing you can do unless the seller volunteers a personal refund, which I doubt.
